1. Who operates the service

2. What the service is and is not
TrueTier is a catalog of software products with automated uptime checks and price history. We are not the seller of the listed products and not a party to any transaction between you and their makers. Their providers are solely responsible for content, functionality and fulfilment of offers.
3. Accounts
An account may be created by a person over 16. You are responsible for the security of your password. Accounts used for spam, misleading listings or manipulation of ratings may be terminated.
4. Listings
Listing is free and subject to review. Every submission is reviewed by a person. A listing whose site carries our status badge is published within 24 hours; any other listing within 48 hours and never before 40 hours after submission. A listing that has paid for instant publishing is published the moment the payment is made and reviewed afterwards; if it breaks these terms it is removed and the credits are refunded. By submitting content you confirm you have the right to publish it, and you grant us a non-exclusive, royalty-free licence to display it within the service and its promotion. We may refuse or remove a listing, particularly for misleading descriptions or non-existent products.
5. Uptime checks and price history
Published products are checked automatically and changes of price and deadline are recorded. This data is informational and automated; we do not guarantee its completeness or accuracy and are not liable for decisions made on its basis. Publishing this data is part of the service and cannot be disabled individually.
6. Discounts and price display
If you publish a discount, you are responsible for the accuracy of the reference price. For discounts we display the lowest price of the preceding 30 days in line with Directive (EU) 2019/2161.
7. Paid services and payments
Instant publishing, boosting, partner placement, the top-spot auction, suggested-alternative placement and the mail to subscribers are paid in credits and always visibly marked. They do not affect ratings, upvotes or uptime results. Credits are prepaid, valid for twelve months, and refunded to the credit balance when a paid placement cannot run.
An in-depth audit is a private consulting service delivered within 5 business days of payment. A hands-on review is a public editorial service: we use the product for at least 7 days and publish the review within 14 days of payment. If we miss either date, the price is refunded in full and the service is still delivered. Capacity is limited to 5 audits a month; once it is reached, no further audit can be ordered until the next month.
All prices on the site are stated excluding VAT. Payments are processed by Gumroad, Inc. as Merchant of Record: at checkout it adds VAT or sales tax according to the buyer's country, collects it, issues the tax document and remits the tax. The amount you pay is therefore the listed price plus the tax of your country.
When the free allowance of site checks or of a free tool is used up, an extra run can be bought for the price shown on the site, with or without an account. One extra run is one full site check or one run of any tool on /tools, at your choice. On payment the runs are credited to the account or, without one, delivered as a pass to the browser used and as a link sent to the e-mail given at checkout. They are used only after the free allowance, do not expire and cannot be exchanged back for money.
7a. Binding rules for paid placement
The following rules form part of this contract and are binding on us. Their full wording with reasoning is on the Five rules page.
- Paid placement always sits in a separate, visibly marked section. It is never mixed with ranking earned through upvotes or ratings.
- User upvotes cannot be bought with money or credits, directly or indirectly.
- A commissioned review is published regardless of outcome. The client does not see it before publication and has no right to have it withdrawn or edited. They do have a right of public reply.
- Instant publishing means publication at the moment of payment, with the review afterwards — not a right to stay published. A listing removed at review is refunded in full.
- Daily uptime checks and the record of price and deadline changes cannot be disabled, hidden or edited at the maker's request.
All published paid content is marked as paid in accordance with consumer protection law and Directive (EU) 2019/2161.
7b. Competitor monitoring and API
The monitoring service fetches publicly available pages that you specify and compares their content. You are responsible for having the right to monitor those pages and for not breaching their operator's terms. We do not monitor content behind authentication and do not circumvent technical protections. Detected changes are automated, informational, and we do not guarantee completeness or accuracy.
Plan limits are counted per monitored page. For lifetime licences we reserve the right to change technical parameters if operating the service ceases to be sustainable; in that case we give at least 90 days' notice.
API access is tied to your account, is rate limited and must not be used for bulk copying of the catalog. When publishing our data, cite the source with a link.
7c. Credits
Credits are a prepaid unit used to pay for placements and services. One credit corresponds to 10 USD excluding VAT. They are valid for 12 months from the date credited and expire afterwards. They cannot be exchanged back for money or transferred to another account. Member discounts have a monthly cap and do not combine with volume discounts. Until spent, credits are recorded as a prepayment received.
7d. Language model analysis
The competitor comparison feature sends the text of the compared pages to a language model provider at your request. This happens in one of two ways depending on your choice: under our access within the monthly and daily limits of your plan, or under your own key without a limit and at your expense. Your own key is stored encrypted and used for nothing else. If you do not run an analysis, nothing is sent.
Plan limits are shown on the tool page and exist to prevent abuse. Analyses beyond the limit can be purchased with credits; if an analysis fails, the credit is refunded. Model output is an estimate, not a fact, and we are not liable for decisions made on its basis.
8. Right of withdrawal
As a consumer you have the right to withdraw within 14 days without giving a reason. For digital content and services supplied immediately, you expressly agree to performance beginning before that period expires and acknowledge that you thereby lose the right of withdrawal. If an audit has not started, we refund in full.
9. Limitation of liability
The service is provided "as is". To the extent permitted by law we disclaim all implied warranties. Our total liability is limited to the amount you paid us in the preceding 12 months. We are not liable for indirect or consequential damages or lost profits. This limitation does not apply where the law does not permit it.
10. Governing law
This contract is governed by the law of the Slovak Republic. Your consumer rights under the law of your country of habitual residence are not affected. Disputes are resolved before the competent courts of the Slovak Republic, or out of court through the Slovak Trade Inspection or the European Commission's online dispute resolution platform.
11. Language versions
These terms are published in English and Slovak. The English version is authoritative; the Slovak version is an informational translation. In case of conflict the English wording prevails, except where mandatory consumer protection law of your country of residence requires otherwise.
12. Changes
We may change these terms. We give notice of material changes by email or a notice on the site at least 15 days in advance. Continued use of the service constitutes acceptance.
